1. Acceptance of Terms

By downloading, installing, or using the WellFit mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

WellFit is a health and fitness tracking application that provides:

• Food logging with AI-powered photo recognition, USDA database search, Open Food Facts database search, and barcode scanning
• Personalized nutrition planning
• Custom fitness program generation
• Weight tracking
• Workout logging
• Progress analytics and insights
• Apple Health integration for syncing health and fitness data with other apps and devices (optional)

3. Eligibility

You must be at least 13 years old to use WellFit. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent and warrant that you meet these age requirements.

4. User Account and Data

4.1 Profile Creation

When you first use WellFit, you create a profile by providing personal information such as age, height, weight, and fitness goals. You are responsible for maintaining the accuracy of this information.

4.2 Data Accuracy

You acknowledge that:

• Nutritional data from AI recognition is estimated and may not be 100% accurate
• USDA database information is provided by third parties and we do not guarantee its accuracy
• Open Food Facts is a crowd-sourced database; product data may be incomplete, outdated, or inaccurate
• Barcode scanning depends on the product being listed in the Open Food Facts database
• Fitness calculations (BMR, TDEE, macro targets) are estimates based on standard formulas
• Apple Health data accuracy depends on the source devices and apps that wrote it
• You are responsible for verifying nutrition information before relying on it

4.3 Your Responsibility

You are solely responsible for:

• The accuracy of data you enter into the App
• Decisions you make based on App recommendations
• Monitoring your own health and well-being
• Consulting healthcare professionals before making significant diet or exercise changes

5. Medical Disclaimer

WellFit is not medical advice. The App provides general information about nutrition and fitness for educational purposes only. It is not intended to:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace professional medical advice, diagnosis, or treatment
• Be used as a medical device or health monitoring tool

Always consult your physician or qualified healthcare provider before:

• Starting any new diet or nutrition plan
• Beginning an exercise or fitness program
• Making changes to existing health routines
• If you have any health concerns or medical conditions

6. Third-Party Services

6.1 Services Integrated in WellFit

WellFit communicates with the following third-party services on your behalf. No API keys or accounts are required from you.

• Google Gemini AI: For AI food photo recognition (used automatically when online and you tap the photo scan button)
• USDA FoodData Central: For nutritional data (used when you search the USDA database)
• Open Food Facts: For product identification via text search or barcode scanning (no account required; open database)
• Apple Health (HealthKit): For syncing health and fitness data on your device (disabled by default; no external servers involved)
• Apple StoreKit: For processing WellFit Pro subscription payments via your Apple ID

6.2 Third-Party Terms

Use of third-party services is subject to their respective terms:

7. Subscription and Payments

7.1 Free and Pro Features

WellFit offers both free and Pro (paid subscription) tiers. WellFit Pro includes:

• 30 AI food photo scans per day (free tier: 3 per day)
• Meal Templates — save and reuse favourite meal combinations
• Streak Recovery — restore a missed day once per calendar month
• 30-day analytics with period comparison (free tier: 7-day)
• Smart notifications — streak-at-risk alerts, progress-aware reminders
• Data export (JSON)
• Daily personalised coaching cards

7.2 Subscription Terms

If you purchase a WellFit Pro subscription:

• Subscriptions are processed by Apple and charged to your Apple ID account
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple ID Account Settings or at https://apps.apple.com/account/subscriptions
• Refunds are handled by Apple according to their policies
• WellFit does not process or store any payment information

7.3 Free Trial

WellFit Pro includes a 14-day free trial for new subscribers:

• You will not be charged during the trial period
• You must cancel before the trial ends to avoid being charged
• Only one free trial per Apple ID per subscription product
• We may discontinue free trials at any time

7.4 Price Changes

We reserve the right to change subscription prices. Apple will notify you of price changes before your next renewal, and you may choose to cancel if you do not accept the new price.

8. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or hack the App
• Share your Pro subscription with others
• Scrape, mine, or extract data from the App
• Use the App in a way that could damage, disable, or impair it
• Violate any third-party terms of service (Google, USDA, Apple)
• Use the App to provide medical advice to others

9. Intellectual Property

9.1 Our Rights

All content in the App, including:

• Software code and algorithms
• Exercise library and workout programs
• User interface design
• Graphics, logos, and branding

...is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

9.2 Your Data

You retain all rights to the data you enter into the App (food logs, photos, etc.). By using the App, you grant us a license to use this data solely to provide App functionality.

9.3 Exercise Library

The exercise descriptions, instructions, and workout programs are provided for personal use only. You may not reproduce, distribute, or create derivative works without permission.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of nutrition data
• Uninterrupted or error-free operation
• Results from following nutrition or fitness recommendations

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any injuries, health issues, or adverse effects from using the App
• Inaccurate nutritional information or calculations
• Data loss (always back up your device)
• Third-party service failures (Google AI, USDA, Open Food Facts, Apple Health)
• Indirect, incidental, consequential, or punitive damages

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS.

10.3 Health and Safety

YOU ASSUME ALL RISK FOR ANY HEALTH OR FITNESS ACTIVITIES. We are not responsible for:

• Injuries from workouts or exercises
• Adverse reactions to dietary changes
• Failure to achieve fitness goals
• Decisions made based on App data

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of third-party rights
• Health issues or injuries related to App use

12. Termination

12.1 By You

You may stop using the App at any time by deleting it from your device. To delete all data, use the "Delete All Data" feature in Settings before uninstalling. Manage or cancel your subscription separately via Apple's App Store.

12.2 By Us

We may terminate or suspend your access if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the App or our services

12.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App and all copies
• No refunds for unused subscription time
• Locally stored data remains on your device unless you delete it

13. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted with a new "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

We will notify you of material changes through:

• App update notes in the App Store
• In-app notification

14. Geographic Restrictions

WellFit is available worldwide, but:

• Some features may not be available in all countries
• Third-party services (Google, USDA) have their own geographic restrictions
• You are responsible for complying with local laws

15. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Romania.

16. Dispute Resolution

For any disputes:

1. Contact us first to attempt informal resolution
2. If unresolved, disputes will be handled through binding arbitration
3. You waive the right to participate in class action lawsuits

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
